A jury found appellant, Celestino Villarreal, guilty of the offense of burglary of a habitation with intent to commit theft.*fn1 After he pleaded true to an allegation in the indictment that he was a repeat felony offender, the trial court assessed appellant's punishment at twenty-five years imprisonment. By four points of error, appellant contends: (1) the evidence is legally and factually insufficient to sustain his conviction; (2) the trial court erred in overruling his objection to the prosecutor's comment that he failed to testify; and (3) the trial court erred in denying his motion for new trial based on newly discovered evidence. We affirm.
